Is DHgate Legit? Replicas, Customs Seizures and What Buyers Risk

Is DHgate legit? As a company, yes. It is a Chinese cross-border marketplace founded in 2004 that says it connects tens of millions of buyers with millions of sellers. As a source of designer goods, the picture changes. The US government has named DHgate on its list of notorious markets for counterfeiting in each of its last two reviews, and in April 2025, amid viral TikTok videos about cheap “factory” luxury, its app reached No. 2 on Apple’s US App Store. If what you order turns out to be a replica, customs in the US, UK and EU can seize it, and you may lose your money. Here is what DHgate is, what the law says, and what buyers actually risk.

Short answer: DHgate is a real, established marketplace that has operated since 2004, not a scam site. But the US Trade Representative still lists it as a notorious market because counterfeits remain easy to find. Replicas bearing fake trademarks can be seized by US, UK and EU customs, even when bought for personal use, and refunds are not guaranteed.

Key takeaways

  • DHgate was founded in 2004 by Diane Wang. The company said it had more than 77 million registered buyers in 225 countries and regions and 2.6 million sellers at the end of 2023.
  • The USTR named DHgate in its 2024 and 2025 Notorious Markets reviews. The 2025 review, released on 3 March 2026, says it “remains a significant source of counterfeits”.
  • US customs seizes and forfeits goods bearing counterfeit marks, and then discloses the importer’s name and address to the brand owner where available. The personal-use exemption covers travellers, not parcels.
  • The EU Court of Justice ruled in Blomqvist v Rolex (C-98/13) that a fake bought from a non-EU website for personal use can be detained at the EU border.

What is DHgate, and is it a real company?

DHgate is a real business. DHgate Group’s own press materials say it was founded in 2004, and they name Diane Wang as founder, chairperson and chief executive. As of 31 December 2023 it reported more than 77 million registered buyers from 225 countries and regions and more than 2.6 million sellers in China and elsewhere. The US Trade Representative describes it as “a leading business-to-business, cross-border e-commerce platform in China that primarily serves purchasers outside of the country”.

That model matters. DHgate is a marketplace, so the goods are listed and shipped by independent sellers rather than by DHgate itself. Not every listing carries a brand. The concern raised by the US government is with the listings that copy famous trademarks, and how easy they are to find.

Is DHgate on the US Notorious Markets list?

Yes. The USTR’s annual Review of Notorious Markets for Counterfeiting and Piracy names DHgate in both the 2024 review, released in January 2025, and the 2025 review, released on 3 March 2026, which lists 37 online markets in total.

The entries are balanced. The 2025 review records that some right holders “reported a good relationship with the platform” and credits DHgate with making its pilot IP enforcement programme permanent, using AI screening tools, verifying vendors and publishing a guide for law enforcement. It also says that “some stakeholders continue to observe that DHgate remains a significant source of counterfeits that remain easily accessible through search results”, with little transparency about penalties and “ineffective deterrence against repeat infringers”. It notes reports of US law enforcement cases involving purchases from the platform, and sellers who evade filters with misspelled brand names and blurred logos. The 2024 review made similar points, and added that DHgate had removed twice as many infringing listings in 2023 as in 2022.

The list is not a legal finding. The USTR states that the list “does not make findings of legal violations”, so it should be read as a summary of complaints and responses rather than a ruling against DHgate.

Why did DHgate go viral on TikTok?

In April 2025, as US tariffs on Chinese goods rose sharply, TikTok filled with videos from people claiming to be Chinese manufacturers of luxury goods and offering to sell direct. Fortune reported on 17 April 2025 that DHgate had reached No. 2 among apps on Apple’s US App Store, with Taobao at No. 7. One viral video claimed that Lululemon leggings came from two factories in Yiwu. Lululemon told Fortune it “does not work with the manufacturers identified in the online videos”. Another creator claimed to be the original manufacturer for most luxury handbag brands, including Hermès, which did not respond to Fortune.

The legal point is simple. A bag made in a factory that has never had a contract with the brand, carrying that brand’s logo, is a counterfeit, whatever the video says. A lookalike without the logo may be lawful, which is the line FLJ draws in dupes vs counterfeits: the legal line explained.

Can US customs seize a DHgate order?

Yes. Under 19 CFR 133.21, US Customs and Border Protection (CBP) can detain any import bearing a suspected counterfeit of a trademark that is registered with the US Patent and Trademark Office and recorded with CBP. If it decides the mark is counterfeit, CBP “will seize such merchandise” and, without the brand owner’s written consent, forfeit it. After a seizure, CBP will disclose to the brand owner, within 30 business days and where available, the importer’s name and address along with the exporter’s and manufacturer’s details. So a “DHgate seized” notice can also put your details in the brand’s hands.

Many buyers have heard of a “one item” allowance. It exists, but it is narrower than people think. 19 CFR 148.55 lets a person arriving in the United States bring in one article of each type bearing a counterfeit mark for personal use, once every 30 days, and only for articles “accompanying” the traveller. It applies to goods of foreign manufacture bearing marks recorded by US owners. It does not cover goods posted to you, and an exempted item sold within a year can be forfeited. FLJ covers the traveller rules in buying fakes abroad.

Fines and prosecution are aimed mainly at sellers. CBP’s civil fines under 19 CFR 133.27 apply to importation “for sale or public distribution”, and the federal counterfeiting offence in 18 U.S.C. 2320 covers people who “traffic” in counterfeit goods. The scale of enforcement is set out in what US customs seized in 2025.

The end of the de minimis exemption has also changed the economics. Duty-free treatment for parcels worth $800 or less ended for goods from China and Hong Kong on 2 May 2025, and for all countries on 29 August 2025 under Executive Order 14324. After the Supreme Court’s tariff ruling in February 2026, the suspension was kept in place, and in June 2026 CBP published an interim final rule suspending the exemption indefinitely for non-postal shipments, with a parallel rule for mail. Congress has repealed the exemption by statute from 1 July 2027. Low-value parcels now go through customs entry procedures and may owe duty, as explained in the end of de minimis.

What happens to replicas bought from the UK or EU?

Where you liveCan customs stop a fake bought for personal use?Key rule
United StatesYes. CBP seizes and forfeits goods bearing counterfeit marks.19 CFR 133.21; traveller exemption in 19 CFR 148.55 does not cover parcels
European UnionYes. A sale to an EU buyer from a non-EU website is enough for the brand to rely on its rights at the border.Blomqvist v Rolex, C-98/13 (CJEU, 2014)
United KingdomYes. Border Force can detain suspected fakes, and small parcels can be destroyed without a court case.Small consignments procedure: 3 or fewer items, or under 2 kg

The EU case started with a watch. In January 2010 Martin Blomqvist, who lived in Denmark, ordered a “Rolex” from a Chinese online shop through its English-language website. It was posted from Hong Kong, and Danish customs held it as a suspected fake, and he refused to agree to its destruction. In its judgment of February 2014, available on EUR-Lex, the Court of Justice held that the right holder is protected “merely through the acquisition of the goods” once they enter a member state, and that it did not need to show the seller had first targeted EU consumers with offers or advertising. The ruling deals with customs detention; whether a buyer also faces a fine depends on national law.

In the UK, the criminal offences in section 92 of the Trade Marks Act 1994 apply to people acting “with a view to gain” or intending to cause loss, which targets sellers rather than someone buying for themselves. That does not protect the parcel. Under the UK’s small consignments procedure, Border Force can destroy suspected counterfeits arriving by post or courier, without first consulting the brand, when the parcel holds three or fewer items or weighs under 2 kilograms and the brand has asked for that procedure.

Can you get your money back if a DHgate order is seized?

Sometimes, but do not count on it. Read the platform’s own dispute terms before you pay, because a seized replica is a different case from a parcel that never left the warehouse. Your payment method also matters:

  • UK credit cards. Section 75 of the Consumer Credit Act can make the card issuer jointly liable for items costing more than £100 and no more than £30,000, but Citizens Advice notes that it usually does not apply when you pay through a third party such as a marketplace or a wallet like PayPal. Chargeback, a card scheme process, may still be available. See Citizens Advice’s guide.
  • PayPal. Citizens Advice says you have 180 days from payment to open a dispute.
  • US credit cards. Under the Fair Credit Billing Act, the Federal Trade Commission says a written dispute must reach the card issuer within 60 days of the first bill showing the error, and covered errors include goods not delivered as agreed.

A practical warning: if you knowingly ordered a replica, a claim that it was “not as described” is weak, and a seizure notice from customs is evidence of what you bought. If you were sold a fake you thought was genuine, keep screenshots of the listing and every message. FLJ’s guides to refund rights for counterfeits on Amazon and how to spot counterfeit luxury before buying apply here too.

So, is DHgate legit or not?

Both statements are true. DHgate is a legitimate, long-running company with an IP complaints system that some brands say works. It is also a platform the US government says still hosts easily found counterfeits. For unbranded goods, the main risks are the usual ones for cross-border marketplaces: quality, slow delivery and, in the US, duties that no longer disappear under $800. For anything carrying a luxury logo at a fraction of the retail price, assume it is fake, and assume customs may agree. For a comparison with other Chinese platforms, see is SHEIN legit?

Frequently asked questions

Is DHgate legit or a scam?

DHgate is a real company, founded in 2004, not a scam site. But the USTR lists it as a notorious market because counterfeit listings remain easy to find, so branded goods sold far below retail price are a high risk.

Does DHgate sell real designer bags?

Luxury brands generally sell through their own stores and websites and through authorised retailers. A designer-branded bag from an independent DHgate seller at a fraction of the retail price should be treated as a likely counterfeit.

What happens if my DHgate order is seized by customs?

In the US, CBP seizes and forfeits goods with counterfeit marks and may share your name and address with the brand owner. In the UK, Border Force can destroy small parcels of suspected fakes. You may not get a refund.

Is it illegal to buy replicas for personal use?

In the US and UK, the main criminal offences target people who sell or traffic in fakes. But customs can still seize the goods, and in the EU the outcome for buyers depends on national law. The Blomqvist ruling confirms seizure is possible.

Can I bring one fake item into the US?

Only as a traveller. 19 CFR 148.55 allows one article of each type bearing a counterfeit mark every 30 days if it accompanies you on arrival. It does not apply to items mailed to you.

Why did DHgate trend on TikTok?

In April 2025, as US tariffs on China rose, viral videos claimed Chinese factories made luxury goods and urged viewers to buy direct. Fortune reported that DHgate reached No. 2 on Apple’s US App Store.

This article is general information about DHgate, customs law and consumer rights in the US, UK and EU as of October 2026. It is not legal advice, and it makes no allegation against DHgate or any seller beyond what the cited authorities and reports state.
